Kosh provides a custom domain email service that allows users to set up and manage email addresses using their own domain names. The Service includes email hosting, domain management tools, user administration, and related features. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Acceptable Use
You agree not to use the Service for any unlawful purpose or in violation of these Terms. Prohibited activities include but are not limited to: sending spam or unsolicited bulk email, distributing malware or viruses, impersonating any person or entity, engaging in phishing or fraudulent activities, violating any applicable laws or regulations, or attempting to gain unauthorized access to the Service or its related systems.
5. Domain Ownership
You represent and warrant that you have the legal right to use any domain name you register with the Service. Kosh is not responsible for resolving domain ownership disputes. You must verify ownership of your domain through our DNS verification process before it can be used with the Service. Failure to maintain valid domain ownership may result in service interruption.
6. Email Content & Storage
You retain ownership of all content sent, received, and stored through the Service. Kosh does not claim ownership of your email content. However, you grant us a limited license to process, store, and transmit your content solely for the purpose of providing the Service. We implement industry-standard encryption and security measures to protect your data.
7. Service Availability
While we strive to maintain high availability, we do not guarantee uninterrupted access to the Service. Scheduled maintenance, system updates, and unforeseen circumstances may cause temporary service interruptions. We will make reasonable efforts to notify users in advance of planned downtime. The Service is provided on an "as is" and "as available" basis.
8. Intellectual Property
The Service, including its original content, features, and functionality, is owned by Kosh and is protected by international copyright, trademark, and other intellectual property laws. Our trademarks and trade dress may not be used in connection with any product or service without prior written consent. You may not copy, modify, distribute, or create derivative works based on the Service.
9. Account Termination
We may terminate or suspend your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users of the Service, us, or third parties. Upon termination, your right to use the Service will immediately cease. You may export your data before termination where technically feasible.
10. Limitation of Liability
To the fullest extent permitted by law, Kosh shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising under these Terms shall not exceed the amount you have paid us in the twelve months preceding the claim.
